Connor has allowed police officers to determine the “reasonable” amount of force to be used in a situation.26 Law enforcement now has more power because instead of following a mechanical set of standards, they are required to make split-second decisions.27 In many instances, police officers can argue in court that “excessive force” was necessary based on their interpretation of the incident at the time.28 Therefore, the scope of discretion is extremely large because Graham v. Connor does not state explicit guidelines for what is “excessive force”.
The Fourth Circuit argued that there was “insufficient evidence that the officers maliciously and sadistically tried to hurt him”.9 Graham then petitioned the Supreme Court. After the Supreme Court ruled for officers to be judged on the “objective reasonableness” standard found in Graham v. Connor, the Graham standard was created.13 The International Association of Chiefs of Police and Fraternal Order of Police currently work together to set the guidelines for police training.14 After 1989, the organization decided to implement the Graham standard when teaching officers about excessive force.15 According to Tracy Avelar, the captain of the Foster City Police Department, the Graham standard states, “the ‘reasonableness’ of a particular use of force must be judged from the perspective of a reasonable officer on the scene and must embody an allowance for the fact that police officers are often forced to make split-second decisions”.16 The Graham factors include: the severity of the crime, the threat the suspect poses, and whether the suspect is resisting or avoiding arrest.17 Although the Graham standard provides police officers with a base, Greg Meyer from the LAPD argues that officers also take into account subjective factors such as physical build, intoxication, and demeanor.18 The Graham standard allows officers to determine the amount of force needed based on the situation at the scene. Since 1989, the Graham standard has been intensely debated and protested, but recently the question of race has become a factor, and the motives and potential biases of police officers regarding people of color has come to public attention.
In a 9-0 decision, the Supreme Court also ruled against Graham, but they also ruled against the Fourth Circuit.
